What paper work is required for a mediation?
It only takes two pieces of paper for a mediation to happen.
- The "Agreement to Mediate" needs to be authorised. This is an agreement between all the parties to the dispute and the mediator. It sets out the frame work and the terms as to how the mediation will happen and the engagement of the mediator.
- The "Confidentiality Agreement" needs to be authorised. Mediation is a confidential process. All people present at a mediation, including the mediator, the parties, lawyers, other advisors, support people and anyone else attending the mediation, must authorise this confidentiality agreement prior to the mediation commencing.
